Treatment of Tax Credit Triggers in Fiscal Notes

Legislative Council Staff (LCS) fiscal notes estimate a bill’s fiscal impact relative to current law. There are four tax credits in current law, known as triggered tax credits, whose availability or amounts are dependent on state revenue conditions. Bills that affect state revenue subject to TABOR may affect the availability or level of these triggered tax credits. If a bill impacts state revenue subject to TABOR such that it is expected to change the availability or level of a triggered tax credit, the bill’s fiscal note will show revenue impacts that result from that change.

Funding Mechanisms and Fiscal Notes

This memorandum is intended for use by policymakers, legislative drafters, and budget analysts to understand the different funding mechanisms that may be used in legislation. It describes how different funding mechanisms in legislation impact the state budget and how they are shown in fiscal notes prepared by Legislative Council Staff. These funding mechanisms include appropriations, transfers, diversions, and warrants on state funds, as well as fee revenue and gifts, grants, or donations. The memorandum concludes with a list of funding mechanisms for which voter approval is required.

The Impact of Tax Increment Financing on School Finance

Public K-12 education in Colorado is financed through state and local sources. The school finance formula in state law establishes a statewide total funding level. The difference between this amount and the local share determines the state’s school finance obligation. The local share is paid primarily from property taxes. Exemptions, policy adjustments, or other factors that reduce or slow the growth of property taxes requires the state to increase its share of K-12 education funding.

Higher Education Enrollment and Tuition Revenue Forecast

This memorandum presents the 2025 Legislative Council Staff forecast for the state public institutions of higher education. The forecast provides projections of resident and nonresident full-time equivalent (FTE) student enrollment and College Opportunity Fund (COF) FTE enrollment for the current fiscal year (FY 2024-25) and budget year (FY 2025-26). The forecast also includes projected tuition revenue for FY 2024-25.
